M and F of Richmond, Inc.

On February 6, 2022, I signed a contract with Mike Miller from M and F of Richmond Inc to build a duplex with a 1.5 car attached garage. As requested, I gave him a $50,000 deposit. Unfortunately, it took him 8 months to produce acceptable blueprints, and the building permit was only issued on November 22, 2022. Mr. Miller informed me that the building would take three months to complete once the permit was received. However, we are now at 2.5 months since receiving the permit, and no work has been done. The initial footing dig was scheduled for January 12, 2023, but it was delayed because Miss Utility had to mark the property. When the digging finally took place on January 21, 2023, we encountered several issues. The survey stakes that I had paid to have put in were moved by the tree removal person that Mr. Miller hired, and there was an existing HVAC compressor obstructing the dig area. Mr. Miller refused to take responsibility for these additional expenses, so I officially cancelled the contract in writing on January 22, 2023, and demanded a refund of my deposit by January 27, 2023. Mr. Miller did not respond to my request, and I have since turned the matter over to my attorney for resolution. In response to my email on January 22 and January 27, Mr. Miller emailed me on January 28 stating that he considers the contract legal and binding and still in force. However, he mentioned that work would cease until the issue is resolved, but he didn't specify what the issue was. I responded with several questions but received no response. Needless to say, my experience with Mr. Miller and M and F of Richmond, Inc. has been a disappointment, and I caution others against handing over full deposits without ensuring trustworthiness, honesty, and follow-through.
